Wtta admission suspended or revoked: what it means for staffing agencies and hiring companies

Under the Wtta, the Dutch Labour Market Admission Authority (NAU) can temporarily suspend or permanently revoke a lender's admission. That directly affects the staffing agency and every company that hires workers through it. Based on the official sources, this article explains how the process works and what you may and may not do at each stage.

Suspension or revocation: what is the difference?

If a lender no longer meets the Wtta conditions, the NAU can suspend or revoke its admission.

SuspensionRevocation
DurationTemporary. The NAU decides the length case by case; there is no standard term. The duration is stated in the decision.Permanent: the lender loses its admission.
PurposeThe lender gets time to fix the problems.For serious situations, for example repeated violations, knowingly providing incorrect or incomplete information, or problems not (sufficiently) fixed after a suspension.
AfterwardsFixed? The admission is resumed and the lender may supply workers again. Not fixed? The NAU can revoke the admission.The lender may no longer supply workers.

Workers' rights continue to apply in all cases.

How does it work? From notice of intent to effective date

  1. Notice of intent. If the NAU intends to suspend the admission, the lender first receives a notice of intent with a deadline to respond (the zienswijze, or statement of views). During that period the lender can take measures and show them in its response; the NAU takes the response into account in its decision.
  2. Decision. The decision states why and from when the admission is suspended or revoked. The lender is notified via the Berichtenbox voor bedrijven (government message box for businesses) and views the decision in the NAU's case system.
  3. Public register. The decision is published in the NAU's public register, with its effective date. Hiring companies can sign up in the register for alerts when a lender's admission status changes.
  4. Effective date. A suspension or revocation takes effect no later than 4 weeks after the decision is announced.

In the parliamentary letter of 26 March 2025 (during the passage of the bill), the minister explained that for less serious violations the response period is at least four months, and that the admitting authority can shorten the four-week period, for example in cases of serious abuses. For your own situation, always follow the deadlines stated in the notice or decision.

As a staffing agency: what may you still do?

StageWhat is and is not allowed
Between announcement and effective dateYou may keep supplying workers who already work at a hiring company. You may not supply new workers and may not supply workers to hiring companies you do not yet work with. The Netherlands Labour Authority supervises this.
During the suspensionYou may not supply workers. You can fix the problems you were suspended for.
After revocationYou may no longer supply workers.

Keeping your admission starts with keeping your records and evidence in order, so that you can quickly show you meet the requirements during an (interim) inspection. See the Wtta checklist for small staffing agencies and the Wtta requirements.

As a hiring company: what may you still do?

StageWhat is and is not allowed
Between announcement and effective dateYou may temporarily keep using workers you already hire. You may not hire new workers from this lender and may not start a new hiring relationship with it. Use this period to prepare for ending the relationship.
From the effective dateYou may no longer hire workers from this lender. If a suspension is lifted, you may hire from this lender again.

If you still hire from a lender without valid admission, you risk a fine from the Netherlands Labour Authority from 1 January 2028. Checking your lenders' admission is your own responsibility. Read how in Is my staffing agency admitted?

Lodging an objection

If the lender disagrees with a suspension or revocation decision, it can lodge an objection. The decision states how and within what period. During the objection procedure the decision remains in force, unless the NAU decides otherwise. According to the parliamentary letter of 26 March 2025, in urgent cases or where consequences would be irreparable, a lender can ask the administrative court for interim relief.

In practice: avoid surprises

The official checklist for hiring companies recommends, among other things, to:

  • state in the contract that cooperation is only possible with an NAU admission or exemption, and that it must remain valid for the entire term;
  • agree what happens if the admission lapses, is suspended or revoked;
  • agree that the lender reports changes in its admission status immediately, and also sign up for alerts in the public register;
  • check periodically that the lender is still admitted, and keep proof of each check;
  • stop hiring if problems arise and record the actions you took.

According to the official planning, the public register of admitted lenders will be available from 1 July 2027. See also the Wtta timeline 2026–2028.

Frequently asked questions

How quickly does a suspension or revocation take effect?

No later than 4 weeks after the decision is announced. The exact effective date is stated in the decision and in the NAU's public register.

Can I keep my current temporary workers from a suspended agency?

Until the effective date you may temporarily keep using workers you already hire. New workers or a new hiring relationship with that agency are not allowed. From the effective date you may no longer hire from that agency.

Is a suspension the same as losing admission?

No. A suspension is temporary: if the lender sufficiently fixes the problems, the admission is resumed. With a revocation the lender loses its admission permanently.

Does an objection suspend the decision?

No. During the objection procedure the decision remains in force, unless the NAU decides otherwise.

How will I know if my lender's admission changes?

You can sign up for alerts in the NAU's public register. Also agree in your contract that the lender informs you of any change immediately.
